Notice template (copy it if the link does not open your email program):
Notice of illegal content (Art. 16 DSA) 1. Why the content is illegal (explanation): 2. Exact location (URL, or IP address and port) and the date and time with time zone: 3. Notifier's name and email address: 4. Statement: I confirm my good-faith belief that the information and allegations contained in this notice are accurate and complete.
If you provide contact details, we will confirm receipt of your notice without undue delay. We handle notices in a timely, diligent, non-arbitrary and objective manner and then inform the notifier of our decision and of the possibilities for redress in respect of that decision. If we use automated means to process a notice, we will say so in our reply.
When information gives rise to suspicion of a past, ongoing or likely criminal offence involving a threat to the life or safety of persons, we promptly notify the relevant law enforcement or judicial authorities and provide the available information. If we cannot identify the relevant Member State, we notify Polish law enforcement authorities or Europol (Art. 18 DSA).
Content moderation rules (Art. 14 DSA)
The following rules form part of the terms on which we provide our hosting services. They apply to content stored on behalf of clients as part of our infrastructure services, regardless of the provisions of individual agreements.
- Restrictions. Our services may not be used to store or make available content that is illegal under European Union or Polish law, or for network abuse (such as spam, DDoS attacks, phishing or malware distribution). An individual agreement may provide for further restrictions.
- Sources of information. We act on notices (Art. 16 DSA), orders from authorities (Art. 9 DSA) and other information that reaches us.
- Measures. Depending on the circumstances, we may ask the client to remove the content or stop the infringement, disable access to specific content or a resource, suspend the service to the extent necessary and, in serious or repeated cases, terminate the agreement in accordance with its terms. Our measures are proportionate and take due account of the rights and legitimate interests of all parties involved, including fundamental rights.
- Tools and human review. Content moderation decisions are taken by a person after assessing the available information. We do not use algorithmic decision-making for this purpose.
- Statement of reasons. We inform a client whose content is restricted of the decision and the reasons for it (Art. 17 DSA), unless the law or an order from an authority prevents this.
- Contesting a decision. A client or a notifier may contest a decision by writing to info@giveme.cloud. The decision is reassessed by a person, and we report the outcome without undue delay. The right to seek redress before a court is not affected.
Network abuse
